These online shopping terms and conditions (“Online Shopping Terms and Conditions”) apply to all orders that you as a customer (“you” or “your”) place through this website “https://www.medizinisch-wohlbefinden-babymilch.de/'' (“Site”) operated by us, Brighton Healthcare Ltd (“we”, “us” or “our”). Please read them carefully before placing your order and print a copy for future reference.

By using this website, you accept these Terms and Conditions for Online Shopping, the Privacy Policy and any other policies that we may notify you of from time to time, which together constitute the entire agreement between us.< /p>

Nothing in these online shopping terms and conditions affects your statutory rights, whether as a consumer or otherwise.

We only sell items to adults (ie those over the age of 18).

If you are under the age of 18, you can only use this website with the involvement of a parent or legal guardian.

THE CONTRACT BETWEEN US:

If you place an order through our website, this constitutes an offer from us to you to purchase these items. We will confirm receipt of your order by sending you an email summarizing the details of your order ("Order Confirmation Email"). We will not accept your order until we send an email confirming that we have shipped the items in your order ("Shipping Confirmation Email"). The contract between us will be formed at the time we send the Dispatch Confirmation email in relation to the items referred to in the Dispatch Confirmation email, whether or not you receive that email. If your order contained multiple items and only some of them are mentioned in the shipping confirmation email, the items that have not yet been shipped to you are not part of the contract.

The purchase of the goods that we sell on this website is a dynamic process and prices from manufacturers are subject to change. Orders placed on Friday will only be delivered after the weekend as our courier service (DPD) does not deliver on weekends. Shipping costs: Base on the weight/dimensional weight of the shipment and the postage costs with DPD courier services (part of the French service - La Post). All deliveries are tracked and there are certain exceptions. Prices shown are for mainland Europe only - ISLANDS OFF THE COAST OF ANY COUNTRY ARE EXPRESSLY EXCLUDED.
For example: In the UK: Does not include the Scottish Isles, Scilly, Jersey, Guernsey or BFPO
For Spain: Islands in the Balearic Islands or other islands off the coast of Spain are not included.
The same applies to other island areas off the coast of all other countries we ship to.

Excluded destinations are also: Andorra, Faroe Islands, Greenland, Aland, Corsica, Guadeloupe, Martinique, Reunion Island, Franz, French Guiana, St. Pierre and others. Miqulon, Mayotte, New Caledonia, French Polynesia, Wallis and Futuna, Madeira, Azores, San Marino, Sardinia, Livignio, Melilla & Ceuta and the aforementioned Balearic Islands, Canary Islands

Deliveries to excluded destinations may be possible by contacting us and paying the additional surcharge.


While we try to ensure that all prices on the website are correct, errors may and may not occur.

If we discover an error in the price of the items you have ordered, we will contact you as soon as possible. You have the option of reconfirming your order at the correct price or canceling it. If we are unable to contact you, we will treat your order as canceled for the incorrectly priced item.

Prices shown on the website are for online purchases only. They do not indicate the price of identical items purchased from our store or otherwise. We reserve the right to update the prices displayed on the website from time to time.

We accept the following payment methods:  Visa, MasterCard & Debit cards through our Opayo payment gateway. We also accept secure payments via PayPal.

Prices are normally quoted in Euros, UK Pounds Sterling and some destinations US Dollars. You can use your credit card, the credit card provider calculates the corresponding exchange rate automatically.

 

CANCELLATIONS:

If you live in the European Union, you have the legal right to withdraw from the purchase of an item (“cooling off period”) within the “cooling off period” of seven working days from the day after the item was delivered to you. switch-off period'). This right applies to almost all items advertised on the site. Exceptions to this are baby food or intimate products, which we cannot accept for reasons of patient safety/hygiene. RETURNS and REFUNDS:

We are happy to accept returns within 7 days of ordering. Just email us at info@medizinisch-wohlbefinden-babymilch.de. If we have already dispatched the order it must be returned for use to Roche Health, 34 Vevay Road, Bray, Co Wicklow, Ireland A98 D9X2 before a refund can be requested. Once we have received the item in its original packaging and condition, we will issue a refund.
If you request to cancel your order/return an item within 7 days of receipt of delivery and we receive the returned item within 10 days of your notification of cancellation/return, we will be happy to issue a refund providing the products are unopened and unused are and in the original packaging. It may take up to 7 days from the date we receive your returned item for the refund to appear in your account. We will refund you using the same method that was used to make the original payment (e.g. a credit card payment will be refunded to the same card or PayPal account). Please note that the speed with which the refund arrives in your account depends on your bank and not on Roche Health.
Please note: some items cannot be returned: baby food/intimate products

 


ITEM DAMAGED DURING TRANSPORT:

If you receive a package from us and the contents have been damaged in transit, we will exchange the damaged items for you free of charge provided you return the damaged items to us within 30 days of acceptance of delivery .

 

Incorrect Item Sent:

If we have sent you an incorrect item, please notify us as soon as possible and return the incorrect item to us in writing, giving the correct details. If you would like us to replace the wrong item with the correct item, we will send you the correct item as soon as possible. We will not charge you for the wrong item and will reimburse you for the reasonable cost of returning it.

 

COST:

We will refund any reasonable costs you incur in returning the items to us if:

  • The items were delivered to you in error;
  • The items were damaged during delivery or are defective or incorrect;

In all other circumstances you will be responsible for the cost of returning items to us (including if you exercise your right of withdrawal during the cooling off period).

You are also responsible for providing us with your correct shipping address. If the address you have provided is incorrect or incomplete and your order is undeliverable, we will do our best to contact you by phone or email to obtain the correct details. If we are unable to contact you or you do not reply within 10 days with the corrected details, the courier service (DPD) will consider the item permanently undeliverable and we will not be able to issue a refund for the order.

 

LIMITATION OF LIABILITY:

To the fullest extent of applicable law and under no circumstances, including but not limited to negligence, shall we be liable to you for any direct, indirect, incidental, special or consequential damages arising out of the use or inability to use the use of the Website, any modification to the Website, any material or data sent or received or not sent or received, or for any of the damages set forth above arising out of the use of, or inability to use, the Products. Under no circumstances shall our liability and that of our suppliers to you and/or third parties exceed €250.
